New Jersey state officials may not obtain, for prosecution purposes, the medical records of an HIV-positive man charged with sexual penetration, a criminal offense, an appeals court holds.
A state statute authorizes disclosure of records of AIDS or HIV infection only in narrow circumstances not met in this case, the Appellate Division said Tuesday in State v. C.M., A-5097-11.
