The Federal Trade Commission's power to bring consumer protection suits against businesses whose computer systems are hacked is under scrutiny in federal court in Newark.

The FTC claims Wyndham Hotels and Resorts, whose data breaches allowed cyberbandits to steal credit card information for hundreds of thousands of customers, acted unfairly in failing to take reasonable steps to safeguard the data and deceptively through a privacy policy posted on its website that misrepresented its security measures.
