The state Supreme Court has agreed to consider whether the New Jersey Wiretapping and Surveillance Control Act can constitutionally allow police here to tap telephone conversations between out-of-state speakers.
In State v. Ates, A-52-12, a Florida man is serving a life sentence for murdering his former son-in-law, Paul Duncsak, in Ramsey on Aug. 23, 2006. There were no eyewitnesses but Duncsak’s fiancée, who was on the phone with him, testified that she heard him shout "no, oh no," and then heard a loud thud.
