State v. Nash, A-36 September Term 2011; Supreme Court; opinion by Albin, J.; decided January 22, 2013. On certification to the Appellate Division. [Sat below: Judges Rodriguez and Payne in the Appellate Division; Judges Isabella and Furnari in the Law Division.] DDS No. 14-1-8784 [49 pp.]

Askia Nash was a licensed librarian and educational media specialist at the Morton Street Middle School in Newark when two 12-year-old special-education students accused him of sexually abusing them. J.B. testified that Nash sexually assaulted him in the school bathroom on three occasions between 1999 and October 2000. K.L. testified that Nash inappropriately touched his shoulders and buttocks. The case was a classic credibility contest between the accused and the accuser. The doctor who examined J.B. found symptoms that could have resulted from either constipation or sexual assault.
