A divided New Jersey Supreme Court on Wednesday kept the playing field unlevel for infertile women and men seeking parental rights to children born from surrogacy arrangements.

A 3-3 impasse in Matter of the Parentage of a Child by T.J.S. and A.L.S., A-130-10, lets stand a lower-court ruling that parental rights do not vest in the wife of a man who sired a child through an anonymous egg donor, which was carried by an unrelated surrogate.
