Department of Environmental Protection inspectors dont carry weapons and cant make arrests, but the state Supreme Court is being asked to decide whether they need a search warrant to enter onto private property.
The Appellate Division said no, affirming a $4,500 penalty visited upon a Clinton Township couple, Robert and Michelle Huber. The panel held the Freshwater Wetlands Protection Act and its regulations allow warrantless searches to monitor compliance.
