The New Jersey Supreme Court continues to address issues surrounding a police sergeant’s improper calibration of Alcotest machines, and in an opinion released Thursday, the court revisited the question of notification procedures required under the court’s 2018 decision in State v. Cassidy.
Associate Justice Michael Noriega penned the opinion in State v. Zingis for a unanimous court that found defendant Thomas Zingis’ driving while under the influence case illuminated a flaw in the notification procedure required after the court’s Cassidy decision. The issue stemmed from New Jersey State Police Sergeant Marc Dennis’ certification of improperly conducted calibration checks of certain Alcotest machines, according to the opinion.
