'Your Personal Attack Is Both Unnecessary and Unfortunate': Chief District Judge Denies Lawmaker's Recusal Request in Manhattan Congestion Pricing Plan

Chief U.S. District Judge Renee Marie Bumb blasted a New York lawmaker for what he wrote in a letter requesting she remove a federal judge from two pending lawsuits over Manhattan’s congestion pricing plan, calling it “an ad hominem attack on a judge.”

In the fight over New York’s Central Business District Tolling Program in New Jersey federal court, Judge Brian R. Martinotti has agreed to recuse himself after New York State Sen. Brad Hoylman-Sigal, D-47th District, and others, questioned the jurist’s ability to be fair and impartial in the proceedings. The senator sent a letter to Bumb which stated that Martinotti had a ”troubling history of recusal violations.”
