In a published opinion, the Appellate Division affirmed a trial court order directing Smith & Wesson to comply with a subpoena issued by the New Jersey attorney general and the New Jersey Division of Consumer Affairs for certain documents as part of a Consumer Fraud Act investigation.

According to the opinion, Smith & Wesson argued that the trial court erred by rejecting the company’s constitutional arguments under the U.S. Supreme Court decision in NAACP v. Alabama. The company further argued that the trial court failed to consider its claims under the First, Second, Fourth, and Fourteenth Amendments and that the court abused its discretion by failing to dismiss, stay, or quash the subpoena under the first-filed doctrine, according to the opinion.
