Plaintiffs’ lawyers are asking for more than $30.6 million in attorney fees for their work pursuing an “especially risky” case against TikTok over alleged privacy violations despite reporting a 1.4% claims rate as part of a class action settlement.
In a motion filed Thursday, lead counsel insisted that their $92 million settlement that resolved Illinois Biometric Privacy Act claims against TikTok was distinct from a similar $650 million agreement with Facebook, which generated a 22% claims rate. For starters, unlike Facebook, TikTok did not concede it used facial recognition technology and had planned to move to arbitrate the claims.
