On March, 9, 2021, the N.J. Supreme Court had its first opportunity to consider the Pregnant Workers Fairness Act (PWFA), which amended existing portions of the New Jersey Law Against Discrimination (LAD), N.J.S.A.15:5-12, to include pregnant or breastfeeding employees as a protected class, and obligated employers to accommodate such employees. In doing so, a unanimous court came down on the side of pregnant and breastfeeding mothers. Delanoy v. Twp. of Ocean, 245 N.J. 384 (2021).

In 2014, plaintiff Kathleen Delanoy, an Ocean Township police officer for over 10 years, became pregnant, with a due date of March 27, 2015.
