Inquiries into whether a litigant is competent are not limited to those who represent themselves in court, the U.S. Court of Appeals for the Third Circuit has ruled.

A three-judge panel ruled that litigants represented by lawyers can also be reviewed for their competency to be involved in cases. The court’s ruling Tuesday comes in the case of Mondelli v. Berkeley Heights Nursing and Rehabilitation Center, which originated in the U.S. District Court for the District of New Jersey.
