A Pennsylvania judge dismissed discrimination claims by a woman against her hospital employers after she was terminated as a certified medical assistant after testing positive for marijuana use.

In Palmiter v. Commonwealth Health Systems, Lackawanna County Court of Common Pleas Judge Terrence Nealon ruled Nov. 10 that plaintiff Pamela Palmiter failed to show sufficient evidence that she was wrongfully terminated and that her medical marijuana use qualified as a nonjob-related “disability” under the Pennsylvania Human Relations Act.
