In a rare ruling withholding qualified immunity in a police civil rights suit, a U.S. District Court judge in Camden has declined to dismiss the case based on questions about whether a Millville police officer told the truth about a roadside encounter with the plaintiff.

U.S. District Judge Joseph Rodriguez said surveillance video of the arrest of David Carpenter obtained from local businesses raises questions about whether the arresting officer, Albert Chard Jr., gave “objectively reasonable” accounts of the arrest in a police report and grand jury testimony.
