A state appellate court has affirmed an agency decision prohibiting New Jersey residents from placing bets on horse races in the state while physically out of state.

The Appellate Division affirmed the 2017 administrative ruling of the New Jersey Racing Commission denying petitioner Lewis Stein’s petition to allow out-of-state wagering. Stein argued that such betting through the state’s Account Wagering System, particularly for account holders, is not prohibited by the 1998 Off-Track and Account Wagering Act.
