ALBANY – Although different medical decisions at critical junctures may have prevented the death of a 58-year-old mother of six, the state cannot be held liable when its doctors had no reason to conclude that the patient’s condition was critical, a Court of Claims judge has ruled.

Judge Philip J. Patti, who sits in Rochester, said the death of Luella Mathis from a rare stomach aneurysm was obviously unfortunate, and possibly preventable. That, however, is not the issue, he said.
