AN ASBESTOS maker’s claim that Weitz & Luxenberg conspired with a New York County Supreme Court clerk to backdate a time-barred asbestos claim has been dismissed, for now.
Southern District Judge Robert W. Sweet, in an opinion released Friday, said G-I Holdings Inc. had failed to identify the name of the case that Weitz & Luxenberg allegedly backdated with the aid of firm paralegals and a clerk, Elba Aguilar.
