The New York State Attorney General Eliot Spitzer’s Charities Bureau was pleased to see publication of the Second Circuit Court of Appeals decision in Martha Graham School and Dance Foundation, Inc. et al v. Martha Graham Center of Contemporary Dance, Inc. and Martha Graham School of Contemporary Dance, Inc., NYLJ, July 10, at p. 18. We were chagrined, however, to note that our appearance on the appeal had been omitted. The Court of Appeals decision accurately recorded the following appearance for intervenor-defendant-appellee: Marla G. Simpson, assistant Attorney General, Charities Bureau; (Michael Belohlavek, deputy Solicitor General; Dietrich Snell, deputy Attorney General, Division of Public Advocacy; William Josephson, assistant Attorney General-in-Charge, Charities Bureau, of counsel), for Eliot Spitzer, Attorney General of the State of New York, on the brief Mr. Spitzer has been and continues to be an active party in the case defending the interest of charity.
