A $25 million defamation action stemming from a controversial sand mine operation in the Town of Riverhead was properly dismissed last summer as a SLAPP suit, the Appellate Division, Second Department, has determined.

The appeals panel in T.S. Haulers v. Kaplan, 9010-01, found that State Supreme Court Justice W. Bromley Hall correctly granted summary judgment to two activist groups defending a lawsuit filed by T.S. Haulers, the operator of the 50-acre site. (The decision is published in today’s Law Journal.)
