JUST DAYS before the start of the retrial of former police officer Charles Schwarz for helping brutalize Abner Louima, the attack on Mr. Louima’s credibility entered a new phase last night, with the scheduled deposition of Mr. Louima’s former civil lawyer.
Given the rare chance to depose a witness pretrial in a criminal case, Mr. Schwarz’s lawyer Ronald P. Fischetti said he believes the deposition of civil attorney Brian Figeroux will help undermine the prosecution’s charge that Mr. Schwarz was the second officer involved in the police station assault of Mr. Louima in 1997.
