CENTRAL ISLIP – In a case involving the rights of individuals convicted of crimes and detained by the Immigration and Naturalization Service, a federal judge has ruled that the agency’s decision to deny bail to an Italian immigrant and his continued detention did not violate due process.
Although Eastern District Court Judge Leonard D. Wexler determined that Louis Evangelista – who faces deportation following a tax evasion conviction – established that his pending lawsuit against the INS regarding his possible deportation was substantial enough to warrant his release on bail, the judge also found that Mr. Evangelista was unable to show that the INS’s denial of bail violated his constitutional rights.
