THE APPELLATE Division, Second Department, has agreed with the Third Department that New York’s temporary moratorium on the construction of nursing homes is legal.
But two dissenting judges have warned that the Department of Health should soon complete its statewide study on whether there is a potential oversupply of nursing home beds.
