The U.S. Sentencing Commission recently considered a proposed amendment to the Sentencing Guidelines that, if enacted, would return substantial discretion to the sentencing judge when the guidelines range for a defendant falls into what is now characterized as Zone C of the Sentencing Table. While this proposed amendment was just deferred for further study, it will likely be considered by the Sentencing Commission again next year.
