MINEOLA – Ruling on an issue not specifically addressed by New York State case law, a judge has found that the driver of a Corvette who allegedly challenged the driver of a Lamborghini to a drag race will face a second-degree manslaughter charge for his opponent’s death during the alleged contest in Oceanside.

Judge Donald P. De Riggi rejected Kevin J. Hart’s argument that he could not be charged with recklessly causing the death of Michael Vasapolli, the other driver, because, as Mr. Hart asserted, Mr. Vasapolli voluntarily participated in the alleged drag race last June on Lawson Boulevard.
