MINEOLA – A school district’s disciplinary hearing regarding a teacher who was later acquitted in criminal court of sexually abusing a middle schooler does not collaterally estop the student from pursuing tort claims in civil court, a judge has determined.

Nassau Supreme Court Justice Anthony L. Parga found that the Hicksville Union Free School District’s disciplinary proceeding did not afford the student a full and fair opportunity to litigate her personal claims against a middle school teacher.
