A STATE appeals panel ordered a new election for a member of White Plains’ City Council after rejecting an argument by the Democratic candidate that the incumbent Republican committed procedural errors in his legal challenge to last November’s vote.

The incumbent, Larry Delgado, had convinced Supreme Court Justice Francis Nicolai that a voting machine in a polling place in an elementary school in northern White Plains jammed during the Nov. 6 election. The judge ordered a new election for only the 18th Election District where the affected polling place was located. The order for the special election was stayed while the appeal was pending.
