GUARDIANSHIP OF ELISAF.J.A. Pursuant to SCPA Article 17-A (22-950/A) — In this proceeding pursuant to Article 17-A of the Surrogate’s Court Procedure Act, the respondent’s mother, who was appointed guardian of the respondent’s person pursuant to a decree dated November 1, 2022, which determined the respondent to be intellectually disabled, filed a petition seeking the additional appointment as guardian of the respondent’s property. In support of the application, counsel for the petitioner affirms that there is a pending cause of action for respondent’s benefit and indicates the intent to establish a supplemental needs trust (SNT) to be funded with the net recovery. By decree dated September 18, 2023, temporary letters of guardianship of respondent’s property were granted to petitioner with limited authority to prosecute the pending cause of action. On this state of the record, it appears to be in the best interests of the respondent that petitioner be appointed as guardian of her property. Accordingly, the application is granted. The decree dated November 1, 2022, is hereby amended to additionally appoint respondent’s mother, Beverly J., as property guardian. The letters of property guardianship shall be limited pursuant to SCPA 702 (10) and confer additional authority to petition to establish an SNT. All other provisions of said decree shall remain in full force and effect. The temporary letters that issued to the mother are to be revoked in the order amending decree to be entered hereon.
