Surrogate MellaESTATE OF FELIX LOPEZ, Deceased (09-0922/B/C/D) — The proposed compromise of the cause of action for decedent’s conscious pain and suffering is approved.¹ The remaining restrictions contained in the Letters of Administration d.b.n. issued to petitioner are now removed. Petitioner is authorized to reimburse herself and her sister, Iris Lopez, as decedent’s funeral creditors, the sums requested in the verified petition. Petitioner is further authorized to pay the sum of $5,000 to the New York City Human Resources Administration (NYC-HRA) in full satisfaction of it claim against decedent’s estate. Petitioner waives statutory commissions (SCPA 2307).Attorney’s fees and disbursements are fixed and determined in the amounts requested.The net proceeds — amounting to less than $50,000 — shall be paid to Madelyn Stazzone, in her capacity as fiduciary of the Estate of Crucita Lopez (File No.: 2017-760), decedent’s surviving spouse and distributee (see EPTL 4-1.1 [a][1]).The Administrator d.b.n.’s account is settled and the Decree signed.
