Surrogate AndersonESTATE OF SASSON SOFFER, Deceased (10-0511/BCDE) — In this application by a co-trustee seeking leave to resign and the appointment of a successor co-trustee for two trusts created under the will of Sasson Soffer, a conference was held following the calendar. Upon the consent of the parties, this proceeding will be held in abeyance until further order of the court.Dated: October 31, 2018

ESTATE OF ERWIN ST. CLAIRE HARRIS, Deceased (17-4662) — This proceeding for an accounting (SCPA 2205) and related relief was brought by the parent of an infant alleged to be a distributee of Erwin St. Claire Harris, who died on June 20, 2017. Petitioner asks the court to issue an order (1) directing the administrator of the estate to account and (2) restraining the administrator from distributing the estate pending a determination of the infant’s status as distributee. Petitioner does not claim to have commenced a judicial proceeding to determine the infant’s status.The request for an accounting is denied, without prejudice to its renewal when and if the infant has been adjudicated as a distributee and thus has an established interest in the information available on an accounting. The request for a restraint is granted to the extent that the administrator is enjoined from making distributions pending further order of the court; provided, however, that the restraint will be lifted if, within three months of the date of this decision, petitioner fails to file, with proof of service on respondent, proof that petitioner has commenced, in a court of competent jurisdiction, a proceeding to determine the infant’s status as distributee and that she has joined the administrator, as Article 17 guardian for Dylan Maxwell Harris, as a party in such proceeding.The Clerk of the Court is directed to mail a copy of this decision, which constitutes the order of the court, to each of the parties herein.Dated: November 1, 2018
