Surrogate GiganteESTATE OF THERESA DILORENZO, Deceased (12/961-A) — This is an application by the limited administrator of the estate to modify the limitations contained in the Limited Letters of Administration issued by this Court on December 3, 2012, so as to enable him to compromise a wrongful death/conscious pain and suffering cause of action on behalf of the decedent.Jurisdiction has been obtained over all necessary parties and the New York State Department of Taxation and Finance has filed a waiver and consent.Upon review of all the papers submitted, the application to modify the limitations contained in the Limited Letters of Administration issued by this Court on December 3, 2012 and to settle the claim for the wrongful death/personal injury on behalf of the decedent in the amount of $200,000.00 is approved. The entire proceeds are allocated to the cause of action for personal injury. Attorney fees, inclusive of disbursements, are fixed and allowed in the total amount of $61,315.55 payable to Christopher J. Albee. The Center for Medicare and Medicaid Services (CMS) shall be paid $44,376.09 as full satisfaction of their lien.The net balance in the amount of $94,308.36 shall be paid pursuant to EPTL 4-1.1 as follows: $72,154.18 to Rinaldo DiLorenzo; $11,077.09 to Regina DiLorenzo; and $11,077.09 to Andrew DiLorenzo.Incidental relief prayed for is granted.Decree signed.Dated: April 2, 2018
