Surrogate MellaESTATE OF NORMAN USHER, Deceased (16/1029/B) — In this proceeding pursuant to SCPA 1809, petitioner, the sole distributee and administrator of decedent’s estate, seeks to disallow two claims: one by Daniel Burgess for monies and services allegedly rendered to decedent and the estate, and the other by Neil Levine, CPA, for professional services rendered to Daniel Burgess.On the return dates of the citation and supplemental process, there were no appearances in opposition. The allegations contained in the petition that respondents failed to submit documentary evidence to substantiate their claims (SCPA 1803) are deemed due proof thereof (SCPA 509).Accordingly, in the absence of any opposition, the petition is granted.Submit decree.Dated: June 6, 2018

ESTATE OF JAMES KAVOURIAS, Deceased (13/1448/A) — On the record, on May 29, 2018, the second time that this proceeding to compel respondent Sheldon H. Kronen to account for his proceedings as executor of the estate of decedent James Kavourias appeared on the calendar, the court granted the petition.Respondent is ordered to file his account, petition for its judicial settlement, and any other submissions required to obtain the issuance of a citation in the accounting proceeding within 60 days of the date that this Decision and Order is served upon him, with notice of entry. Respondent shall then cause citation to be issued and service to be made without undue delay, on all persons interested in each accounting proceeding pursuant to SCPA 2210.This decision constitutes the Order of the court.Dated: June 4, 2018
