*1 Petitioner Joada Wade, who is 72 years old, is a tenant in the apartment building owned by 3044 Wallace Realty LLC (Wallace). Wallace commenced a nonpayment proceeding against petitioner in Civil Court, Bronx County, Housing Part F (the Bronx eviction proceeding) on May 2, 2017 and obtained a warrant of eviction. The presiding judge stayed the execution of the warrant through October 31, 2017 (3044 Wallace Realty v. Wade, Civil Ct, Bronx County, October 4, 2017, Baum, J., L&T index No. 25422/2017), pending resolution of petitioner’s application for assistance from adult protective services (APS). After the application was denied, the judge extended the stay through December 31, 2017, finding that “although [petitioner] has been denied assistance by adult protective services, she is 72 years old, has resided in the apartment for 36 years and her attorney has stated she will be appealing APS’s determination” (3044 Wallace Realty v. Wade, Civil Ct, Bronx County, December 1, 2017, Baum, J., L&T index No. 25422/2017).*2
