ESTATE OF MARY JOAN BARNETT, Deceased (13/1630) — In this uncontested proceeding, Georgia Levis has offered for probate an instrument dated October 18, 1994, purporting to be the last will and testament of her mother, Mary Joan Barnett. ESTATE OF MARY JOAN BARNETT, Deceased (13/1630) — In this uncontested proceeding, Georgia Levis has offered for probate an instrument dated October 18, 1994, purporting to be the last will and testament of her mother, Mary Joan Barnett. Both the attesting witnesses, as well as the attorney-draftsperson, predeceased the decedent and petitioner is seeking to offer this instrument as an ancient document.

Decedent died on May 14, 2012 survived by petitioner as her sole distributee. The proof establishes that the propounded instrument had been kept in decedent’s possession until she moved to New York and entered into an assisted living facility, at which time it was transferred to her daughter. After decedent’s death, the petitioner located the instrument and submitted it to the court. The instrument contains the signatures of the decedent and two attesting witnesses, and an attestation clause. It is unsuspicious in appearance and leaves decedent’s entire estate to petitioner.
