ESTATE OF BETTINA BEASLEY, Deceased (10/861/B) — The executor, the decedent's niece and sole testamentary beneficiary, seeks to lift the restrictions contained in the letters testamentary so that she may distribute and judicially account for the remaining proceeds of causes of action arising from the decedent's personal injuries and death settled in the Supreme Court, Bronx County (McKeon, J.), being held in her attorneys' escrow account. The Supreme Court order, inter alia, allocated the entire settlement proceeds to the cause of action for personal injuries, and directed the payment of attorneys' fees and disbursements.

ESTATE OF BETTINA BEASLEY, Deceased (10/861/B) — The executor, the decedent’s niece and sole testamentary beneficiary, seeks to lift the restrictions contained in the letters testamentary so that she may distribute and judicially account for the remaining proceeds of causes of action arising from the decedent’s personal injuries and death settled in the Supreme Court, Bronx County (McKeon, J.), being held in her attorneys’ escrow account. The Supreme Court order, inter alia, allocated the entire settlement proceeds to the cause of action for personal injuries, and directed the payment of attorneys’ fees and disbursements.

The decedent sustained injuries in a nursing home and died on September 29, 2009. The decedent’s distributees are four siblings who consent to the application, and the issue of a postdeceased sibling who were served with process and defaulted. The New York State Department of Taxation and Finance consents to the relief requested.
