ESTATE OF GIOVANNI ASPERTI, Deceased (P/293/02/D) — In April 2016, Polly Gwardyak, as Trustee of a Testamentary Trust established within the Will of Giovanni Asperti for the benefit of Giovanni Luigi Asperti, moved this Court pursuant to SCPA Article 19 for leave to amend a mortgage obligation due to the Trust. Margaret Andreo, Esq. was appointed as a Guardian Ad Litem to protect the interest of the minor trust beneficiary, Giovanni Luigi Asperti, and was an integral part of the negotiations and settlement of this matter throughout several court appearances and conferences.

ESTATE OF GIOVANNI ASPERTI, Deceased (P/293/02/D) — In April 2016, Polly Gwardyak, as Trustee of a Testamentary Trust established within the Will of Giovanni Asperti for the benefit of Giovanni Luigi Asperti, moved this Court pursuant to SCPA Article 19 for leave to amend a mortgage obligation due to the Trust. Margaret Andreo, Esq. was appointed as a Guardian Ad Litem to protect the interest of the minor trust beneficiary, Giovanni Luigi Asperti, and was an integral part of the negotiations and settlement of this matter throughout several court appearances and conferences.

Giovanni Luigi Asperti turned eighteen (18) years of age on December 1, 2016 and on the record in Court on December 21, 2016, he expressed his desire to proceed without counsel, and to complete the within application with his mother, Polly Gwardyak, serving as the sole Trustee of the Testamentary Trust. Accordingly, Ms. Andreo was discharged from her duties as related to this matter pursuant to the Court’s decision of January 5, 2017. In addition, the Public Administrator of Richmond County, who was appointed as a Temporary Co-Trustee of the Testamentary Trust during the pendency of this application, was also discharged of his duties pursuant to the Court’s decision of January 5, 2017. Therefore, Polly Gwardyak is the sole Trustee of the Testamentary Trust for the benefit of Giovanni Luigi Asperti.
