A federal judge has withdrawn sanctions she previously imposed on two attorneys for allegedly interfering with the interview of witnesses in prescription drug litigation, citing “game changing” new testimony from four witnesses who said they weren’t told not to speak with opposing counsel.

Last June, Southern District Judge Katherine Forrest ordered DLA Piper partner Brian John Pendleton Jr. to pay $10,000 for allegedly telling Jeffrey Reed, a former employee of the firm’s client, Benecard Services Inc., during a call not to speak with attorneys for Smart Insurance, the opposing party in a now-settled commercial dispute.
