Manhattan Acting Supreme Court Justice Barry Ostrager has narrowed a legal malpractice case against Herrick Feinstein over tax advice, ruling that four plaintiffs’ claims are time barred, but allowing a fifth plaintiff’s claim to proceed.

In their 2012 lawsuit against Herrick and firm attorneys Michael Kessel and Dennis Russo, a group of property owners argued the firm’s advice on claiming deductions on a donation led to an expensive tax dispute.
