A man who was freed from prison earlier this year after serving 20 years for a murder he says he didn’t commit has been barred from seeking damages against the state as the result of a recent ruling by a Bronx trial judge.
Bronx Supreme Court Justice Robert Torres denied a motion by Richard Rosario, who was freed from prison in March, to amend the order to vacate his conviction because of ineffective assistance of counsel to include newly-discovered evidence as grounds for the vacatur, which would allow Rosario to pursue damages under Court of Claims Act §8-b for unjust conviction and imprisonment.
