A former Brooklyn prep school employee who claims she was fired for reporting that her supervisor used school funds for a personal vacation to Cuba has standing as a private party to sue the school for violating New York’s whistleblower protection requirement, a judge found on Friday.

Acting Brooklyn Supreme Court Justice Loren Baily-Schiffman partially denied Poly Prep Country Day School’s motion to dismiss the case, rejecting the argument that only the attorney general and the school’s board of directors have the power to file suit for violating the Nonprofit Revitalization Act of 2013 for failing to enact policies to protect whistleblowers from retaliation.
