A man should get a new trial because his defense counsel did not object when the prosecutor “grossly exaggerated” the link between the defendant and DNA evidence found on a pistol, an appeals court has decided.

Ruling within its discretion to act in the interest of justice, the Appellate Division, Fourth Department, panel found that Glasco Rozier received ineffective assistance of counsel at his 2014 trial in Erie County Court on a second-degree criminal possession of a weapon charge.
