As a foreclosure defense attorney in Kings County, I can corroborate Lynn Armentrout’s depiction of the daily obstacles homeowners encounter in a court system that seems determined to undermine the express public policy of the statutes that system is charged with implementing—that homeowners be afforded meaningful process and that, where possible, unnecessary foreclosures be avoided. With property values rising in Brooklyn, homeowners are constantly bombarded with scam solicitations from fraudsters of every ilk by mail, telephone and in person. Some scammers even generate ersatz court documents, complete with fake index numbers. I know of more than one homeowner who ignored real legal papers because they were indistinguishable from those of scammers.
