A divided panel of the Appellate Division, Second Department, has reversed a Family Court finding that a girl tossed a 5-month-old kitten in front of a speeding car.

The panel’s 3-1 decision in Matter of Shannel P., 2014-05268/2014-06135, reverses Queens Family Court Judge John Hunt’s 2014 determination that the defendant, who was 12 years old at the time, had committed an offense that would have constituted aggravated cruelty to animals and overdriving, torturing and injuring an animal if committed by an adult.
