Questioning a sentencing framework that “largely failed to distinguish among child pornography offenders with differing levels of culpability and danger to the community,” Eastern District Judge Jack Weinstein explained why he sentenced a defendant to supervised release when federal guidelines recommended years of prison.

After pushing back on child pornography sentences in previous cases, Weinstein returned to the issue Jan. 21 with a 98-page decision discussing why he imposed a sentence of five days time served, seven years of supervised release and a fine on “R.V.”
