A divided state appeals court has reversed a Family Court ruling adjudicating a teen to be a juvenile delinquent based on evidence he stole a $1 pair of sunglasses.

The 3-1 Appellate Division, Third Department, panel said the juvenile delinquency petition that Madison County Family Court Judge Biagio DiStefano approved failed to contain a nonhearsay allegation establishing that the teen stole the sunglasses from the Dollar Store, as reported by the store manager in July 2014.
