A Bronx Family Court judge erred by suppressing a police officer’s identification of the chewed stimulant khat on grounds that the officer lacked the requisite expertise, an appellate panel said.
Ruling in a juvenile delinquency proceeding Nov. 5, the Appellate Division, First Department, said Judge Peter Passidomo had mistakenly held the juvenile’s arrest to be invalid.
