A Manhattan judge has thrown out a putative class action filed by a man who said he was illegally charged 36 cents in sales tax on a bottle of Gold Peak Iced Tea he purchased at a Hudson News store in Grand Central Terminal.

Gary Schultz maintained in Schultz v. Hudson News Distributors, 651805/2014, that since sales tax cannot be charged on iced tea under state tax laws, the store had engaged in deceptive or misleading business practices with the transaction in July 2013 under General Business Law §349.
