The Appellate Division, First Department, rejected an attorney’s plea for leniency based on his war service, charitable contributions, and prior unblemished record, and ordered John Fasciana disbarred on Tuesday.

Fasciana, 70, had been automatically suspended in 2005 after being convicted of 11 fraud counts by a Southern District jury. He was sentenced to two years incarceration, three years of supervised release and, along with a co-defendant, ordered to pay $12.8 million in restitution to EDS, the giant data processing firm he was accused of defrauding.
