ESTATE OF LINDA LAVONDA RICHBURG JAMES, Deceased (13/626/B) — In a restored compulsory accounting proceeding brought by the decedent’s daughter, counsel for the daughter and the administrator, the decedent’s spouse, stipulated on the record in open court to the entry of a 21-day order and consented to service upon respective counsel of all citations and process concerning them. Letters of administration issued to the respondent on April 15, 2014. As there does not appear to be any reason why he cannot expeditiously render his account, the daughter’s application, as amended pursuant to the parties’ stipulation on the record in open court, is granted.

The respondent is directed to file his account, a petition for its judicial settlement, and all of the papers required to obtain the issuance of a citation in the accounting proceeding within 21 days of the date of service upon his attorney of a certified copy of the order to be entered hereon, as stipulated to by the parties. The respondent shall then, without delay, cause the citation to be served upon all parties required to be served in an accounting proceeding pursuant to SCPA 2210. The respondent shall appear before the court from time to time for the purpose of the settlement of his account.
