ESTATE OF ILIA AUGUSTINE LEWIS, Deceased. (09/985) — In this contested probate proceeding, Berenice Augustine (the petitioner) filed a petition seeking to probate a written instrument dated June 14, 2007 (the propounded instrument) as the last will and testament of Illia Augustine Lewis (the decedent).

The decedent died on July 13, 2008, at the age of 86. In the propounded instrument, the decedent nominates the petitioner, who is the decedent’s niece, as executor and bequeathes specific monetary sums to St. Charles Jubilee a/k/a St. Charles Senior Center and St. Boniface Church, with the residuary estate to the decedent’s sister, Bernice A. Augustine. Article SEVENTH of the propounded instrument expressly provides “[m]y children Albert W. Lewis and Gilbert E. Lewis, Shall receive nothing.” Gilbert Edmund Lewis (the objectant), appearing pro se, filed objections to the probate of the instrument, on grounds resembling lack of capacity and undue influence.
