ESTATE OF CHI-CHUAN WANG, Deceased. (03/2550/D/E) — James E. Tcheng, a person interested in the estate of Chi-Chuan Wang either as a distributee or as a direct or indirect beneficiary of each of two propounded instruments, commenced a proceeding by order to show cause for revocation of Andrew Wang’s preliminary letters, the imposition of a surcharge against Andrew Wang, and the issuance, following a hearing, of limited letters of administration to Raymond King, son of decedent’s daughter, Yien-Koo Wang King. Andrew Wang opposes the petition.

Andrew Wang is not the sole fiduciary of Chi-Chuan Wang’s estate. On August 4, 2003, the court directed the issuance of preliminary letters to Andrew Wang and the issuance of letters of temporary administration to the Public Administrator of the County of New York to act jointly with Andrew Wang. Therefore, Andrew Wang may act as a fiduciary of decedent’s estate only in concert with the Public Administrator and, accordingly, cannot, on his own initiative, imperil the estate.1
